In the past few years, what has been described as the “bathroom bill” caused heated debate throughout the United States. Most commonly, these bathroom bills have included legislation introduced to restrict bathroom use based on the sex listed on one’s birth certificate or one’s sex assigned at birth. During the 2017 legislative session, 14 states, including Alabama, Illinois, Kansas, Kentucky, Minnesota, Missouri, New York, South Carolina, South Dakota, Tennessee, Texas, Virginia, Washington, and Wyoming either prefiled or introduced legislation that restricts access to usage based on biological sex (Kralik, 2017). In 2016, the U.S. Supreme Court agreed to take up the case of Gavin Grimm, a transgender male student who was banned from using the boys’ bathroom in his high school in Virginia. The Court, in a divided decision, agreed to put a temporary block on the lower court ruling that had supported the student’s rights to use his preferred bathroom. You may recall that the Target Corporation publicly announced that transgender customers and staff could use the bathroom most closely corresponding to their gender identity. This announcement caused outcries of both support and anger. Colleges and universities across the country have debated whether their campuses should have “all-gender bathrooms” as options for students who are transgender.
